Terms of Service

These Terms of Service ("Terms") govern your use of the Waitless mobile application and website (the "Service") operated by Waitless ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.

1. The Service

Waitless is a restaurant reservation and live occupancy platform. We provide technology that connects diners with partnered restaurants in Hyderabad. We are a technology intermediary — we are not a restaurant and do not prepare or serve food.

2. Eligibility

You must be at least 13 years old to create an account. By using the Service you represent that you meet this requirement. Users under 18 should use the Service under parental supervision.

3. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity that occurs under your account.
• Notify us immediately at hello@wait-less.in if you suspect unauthorised access to your account.
• You may not create accounts for others without their consent.

4. Reservations

• A reservation request is not confirmed until the restaurant explicitly approves it via the Waitless Staff App. You will receive a push notification confirming or declining your request.
• Restaurant availability shown in the app is updated in real time by restaurant staff and may change between your search and booking.
• Waitless is not liable if a restaurant is unable to honour a confirmed reservation due to circumstances beyond our control (emergencies, closures, etc.).
• Overbooking is not permitted — if a restaurant's tables are fully occupied, the booking will be blocked at the time of request.

5. Cancellations

Reservation cancellation policies are set by individual restaurants. Waitless will display the applicable policy at the time of booking. We are not responsible for any cancellation fees charged by partner restaurants.

6. Payments

Payment processing (where applicable) is handled by Razorpay. By making a payment you agree to Razorpay's terms of service. We comply with applicable GST regulations on all transactions where tax is due. A GST invoice will be provided for eligible transactions.

7. Loyalty Points

• Loyalty points are earned on confirmed reservations at rates determined by Waitless and/or the partner restaurant.
• 100 points = ₹10 redemption value.
• Points have no cash value and cannot be transferred or sold.
• We reserve the right to modify, suspend, or terminate the loyalty programme with 30 days' notice.

8. Prohibited Conduct

You agree not to:

• Make false or fraudulent reservations
• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Scrape, crawl, or use automated tools to access the Service
• Post defamatory, offensive, or infringing content
• Impersonate another person or entity

9. Intellectual Property

All content in the Service — including the Waitless name, logo, design, text, and software — is owned by Waitless or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the information displayed (including restaurant availability) will always be accurate in real time.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Waitless shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed ₹500 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hyderabad, Telangana, India.

13. Changes to These Terms

We may revise these Terms from time to time. We will provide at least 7 days' notice of material changes via push notification or email. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
